Legal protection for employees

Employees may have legal protection from civil liability when acting in an official capacity. See sections 266–270 of the Public Sector Act 2022. Liability applies to the State.

Protection applies to conduct performed in an official capacity, and where such conduct was performed in good faith and without gross negligence. The Queensland Government can recover funds or withdraw support if you have not acted in good faith, been negligent or found guilty in a criminal proceeding.

Indemnity and legal help may be available for work-related criminal proceedings, civil proceedings, inquiries or investigations. See the Queensland Government indemnity guideline.
