2. Responsibilities and compliance

2.1 Building owner's responsibilities

Building owners are required to:

  • provide and maintain the building and its services according to statutes, by-laws and regulations
  • provide and maintain buildings that are suitable for use according to the building's classification
  • allow the occupant to have quiet enjoyment of the leased space
  • comply with the conditions of the lease or occupancy agreement
  • meet duty-of-care and common law obligations.

2.2 Responsibilities of the Department of Energy and Public Works

As the government's office accommodation provider and manager, the Department of Energy and Public Works (EPW) is responsible for:

  • managing the portfolio of government office buildings that it controls in accordance with best practice
  • meeting the building owner's responsibilities described above in the case of government-owned buildings providing, coordinating and managing office accommodation for government agencies across the state
  • complying with government policy and Cabinet decisions
  • implementing strategies and guidelines approved by the Deputy Directors-General Accommodation Group.

2.3 Agencies' responsibilities

Agencies are responsible for:

  • occupying and using office accommodation in accordance with statutes, by-laws and regulations
  • complying with the conditions of the occupancy agreement
  • meeting duty-of-care and common law obligations
  • complying with government policy and Cabinet decisions
  • facilitating the implementation of strategies and guidelines approved by the Deputy Directors-General Accommodation Group.

Agencies are encouraged to consult with EPW to obtain additional information or advice in relation to any office accommodation issues.
